What To Do When You Get A Final Notice Of Intent To Levy From The Internal Revenue Service
20th December 2010 by Tax Man No CommentsA FEMALE WITH A SEEMING INSURMOUNTABLE INTERNAL REVENUE TAX ARREARAGE
The writer of a blog post I came across described her Internal Revenue Service dilemma. She grumbled that she owed the IRS about 25,000 dollars and that with fees and penalties there looked to be no prospect of seeing the debt ever resolved.
THE IRS CANNOT TAX OUR RIGHTS
This person should contemplate that we have a right to live and the government can’t tax human rights; or our very right to live. Most citizens don’t know this though, including the IRS employees.
THE PAYMENT PLAN BIT THE DUST
This blog writer wrote that to start with they tried to make monthly payments and that when that when they were unable to continue making them the Internal Revenue Service levied their paycheck leaving them with just $400 dollars a month to survive on. The woman ended up going to a company strongly suggesting that they could get the IRS levy released. She paid them several thousand dollars, and wound up getting nothing but empty promises.
THERE IS A WAY PROVIDED BY LAW TO PUT OFF IRS LEVIES
This would have never happened if this gal had known about how to get an IRS wage levy stopped using the study package I call the IRS Terminator package developed around 26 U.S.C. § 6330. Had she known about it she could have read up on how to ask for and prevail in a CDP Hearing (Collection Due Process Hearing), utilized what she learned, and all tax collection action would have come to a standstill; including the levy of their earnings.
TAX PROFESSIONALS LIKE JK HARRIS OR TAXMASTERS COULD APPEAR VALUABLE IN THEIR TELEVISION ADS, HOWEVER…
Whenever people are on the verge of having an INTERNAL REVENUE SERVICE levy applied to his or her bank account or income don’t know about the procedures of 26 U.S.C. § 6330 to stop an IRS wage levy there is a strong temptation to search for help via television promoters like JK Harris, TaxMasters, or the one the aforementioned blog poster went to claiming to help people stop an IRS wage levy. If a person feel a temptation like that coming on…STOP…and review articles just like a recent one in startribune.com. The StarTribune.com article reports that the Minnesota Attorney General Lori Swanson is suing the “TaxMasters” and accusing the Texas Company of creating brand-new troubles for tax debtors in trouble with the INTERNAL REVENUE SERVICE in Minnesota. The suit alleges that TaxMasters takes significant fees after which it does not deliver on their promises. In its December 16, 2010 write-up the Star Tribune articles that the lawsuit filed by the attorney general alleged that television and radio ads utilized by the firm were deceptive. The suit also takes issue with TaxMasters wanting up to $8,000 in upfront charges. TaxMasters is additionally handling a lawsuit filed by the state of Texas on comparable concerns. The Star Tribune write-up also states that Minnesota Attorney General Lori Swanson has also gone after the INTERNAL REVENUE SERVICE tax debt relief industry in 2008. Her office joined a multistate suit against one of the nation’s largest tax relief firms, JK Harris & Co. That suit resulted in JK Harris stipulating to end the advertising making the “pennies on the dollar” tax negotiation assurances.
DO ORGANIZATIONS SIMILAR TO JK HARRIS AND TAXMASTERS WORK WITH THE IRS IN PREFERENCE TO YOU?
Here’s something I know about businesses such as JK Harris and Taxmasters that the majority of individuals usually do not. In Houston, Texas about July 12, 2005, Steven T. Miller, Commissioner TE/GE gave a talk to IRS Tax Forums saying this:
“I want to salute our partners who have been such a big help at these forums. I want to thank, in alphabetical order, the American Bar Association, the American Institute of Certified Public Accountants, the National Association of Enrolled Agents, the National Association of Tax Professionals, the National Society of Accountants, and the National Society of Tax Professionals.”Mr. Miller told the CPAs and other tax professionals in attendance that he sought to make it easier for them and that the help he was was assuring them of would take the form of continuing to enhance the IRS’s electronic and information services, bringing up to date the Service’s computers, and energetically enforcing the law against the unscrupulous few who are a threat the integrity of their/our business. This makes it look like compelling substantiation that companies like JK Harris, Taxmasters and Harris Graves are really the IRS’s partners in collecting taxes. Maybe this is why no effective steps were is to end people’s IRS problems. I would deem people who elect to deal with these types of firms, to be a victim twice over, once to the Internal Revenue and once to the firm that doesn’t live up its promises, and it appears that the attorney generals of numerous states are agreeing with me. Results like this are why individuals in a position of having overdue taxes or unfiled returns should plan by studying in advance how deal with an IRS notice of levy.
